OVERVIEW

This website is operated by Aussie Outdoor Cushions & Beanbags.

Throughout these Terms of Service, “we”, “us” and “our” refer to Aussie Outdoor Cushions & Beanbags. “You” and “your” refer to the person accessing this website or purchasing from us.

Our store is hosted by Shopify Inc., which provides the ecommerce platform through which we offer our products.

By accessing this website, creating an account or placing an order, you agree to these Terms of Service and the policies referred to within them.

These Terms should be read together with our:

• Shipping and Delivery Policy
• Returns, Refunds, Warranties and Consumer Guarantees Policy
• Privacy Policy
• individual product descriptions, care instructions and safety information

If you do not agree with these Terms, you should not use this website or place an order.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.

  1. ELIGIBILITY AND LAWFUL USE

You must be legally capable of entering into a purchase agreement or have the permission of a parent or legal guardian.

You may use this website and our products only for lawful purposes.

You must not:

• use the website or our products for an illegal or unauthorised purpose
• introduce viruses, malware or other harmful code
• interfere with the operation or security of the website
• attempt to gain unauthorised access to the website, accounts or systems
• scrape, copy or collect website content or personal information without permission
• use the website to harass, threaten, deceive or impersonate another person
• infringe our intellectual property rights or the rights of another party
• submit false, fraudulent or misleading information

We may restrict or terminate access to the website where we reasonably believe these Terms have been seriously breached.

Ending access to the website does not remove either party’s existing legal rights or obligations. Any cancellation or refund associated with an order will be handled in accordance with these Terms, our policies and applicable law.

  1. PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, measurements, photographs, prices and availability information are accurate and current.

Please read the complete product description before ordering. Important information about dimensions, materials, filling requirements, intended use, care and safety may be included on the individual product page.

Unless expressly stated otherwise:

• cushion covers and beanbag covers are sold as covers only
• cushion inserts, polystyrene beans, foam and other filling materials are not included
• accessories shown in lifestyle images are not included
• measurements are approximate and reasonable manufacturing tolerances may apply
• coordinating products or products purchased at different times may not be an exact fabric or colour match

  1. PRODUCT IMAGES, COLOURS AND SCALE

We make reasonable efforts to represent our products accurately.

Colours may appear slightly different because of photography, lighting, screen settings and variations between manufacturing batches.

Some lifestyle images may be illustrative, digitally edited or created to demonstrate the intended look, setting or use of a product. Lifestyle images may not always show the product’s exact scale.

Customers should rely on the written product dimensions and specifications when assessing size, capacity and suitability.

Illustrative images do not permit a product to be materially different from its description. Our obligations under the Australian Consumer Law continue to apply.

  1. PRODUCT USE AND SAFETY

Products must be used only for their stated purpose and in accordance with the product description, care instructions and safety information.

Outdoor products may be described as weatherproof or water-resistant according to the particular product. These terms do not mean that every product is permanently waterproof.

A poolside or outdoor beanbag must not be used as a pool float unless its product description specifically states that it is designed to float.

Floating beanbags and other recreational water products are not lifesaving or flotation-safety devices. Children and non-swimmers must be supervised around water.

Customers are responsible for selecting an appropriate product and following all filling, drainage, drying, storage, supervision and safety instructions.

  1. ORDERS

Placing an order constitutes an offer to purchase the selected products under these Terms.

An automated order confirmation acknowledges that we have received your order. It does not necessarily confirm that the product is available or that the order has been finally accepted.

We may lawfully refuse, limit or cancel an order before fulfilment where reasonably necessary, including when:

• a product is unavailable or discontinued
• incorrect pricing or product information has been displayed
• payment cannot be authorised
• the delivery address is incomplete, unsupported or appears incorrect
• the quantity ordered cannot reasonably be supplied
• we reasonably suspect fraud, unauthorised payment or commercial resale
• fulfilling the order would breach a law or safety requirement

If we cancel an order that has been paid, we will refund the amount paid for the cancelled product unless the payment is subject to a legitimate dispute, chargeback or fraud investigation.

We will not cancel an order without refund merely because a customer has breached an unrelated website rule.

  1. ORDER CHANGES AND CUSTOMER INFORMATION

You are responsible for supplying accurate and complete information, including your name, delivery address, postcode, email address and telephone number.

Orders may be submitted for manufacturing or fulfilment shortly after they are received. We therefore cannot guarantee that an order, colour, quantity or delivery address can be changed after purchase.

We will make the requested change only if the order has not progressed too far to be amended.

  1. PRICES AND PAYMENT

Unless otherwise stated, prices displayed on our Australian store are in Australian dollars.

Prices may be changed at any time before an order is placed. A price change will not retrospectively alter the agreed price of an accepted order.

Applicable charges will be shown during checkout before payment is completed.

If an obvious pricing, discount or product-information error affects an order, we may contact you to:

• proceed at the correct price with your agreement
• select an alternative product
• cancel the affected product and receive a refund

We will not charge a higher price without your agreement.

  1. DISCOUNTS AND PROMOTIONAL OFFERS

Discounts, promotional codes and special offers are subject to any conditions stated with the offer.

Unless otherwise stated:

• only one discount code may be used per order
• discounts cannot be applied retrospectively
• qualifying quantities must be purchased within the same order
• promotions are available only during the stated promotional period
• promotional offers may be limited by product, colour, stock or location

A discount or sale price does not remove any rights a customer has under the Australian Consumer Law.

  1. SHIPPING AND DELIVERY

Our Shipping and Delivery Policy forms part of these Terms.

It explains:

• available delivery locations
• standard delivery estimates
• peak-period and bulk-order timeframes
• direct fulfilment by manufacturers or suppliers
• separate parcels arriving on different days
• plain No Frills packaging
• tracking availability
• safe-place delivery
• incorrect addresses and uncollected parcels
• lost or damaged deliveries

Products within the same order may be fulfilled from different locations and delivered separately.

We do not provide a dispatch or tracking email for every parcel. The absence of a dispatch email does not mean that an order has not been processed.

Delivery timeframes are estimates and may be affected by courier congestion, supplier delays, severe weather, natural disasters, transport disruptions and other events outside our direct control.

Nothing in this section excludes any right or remedy available under the Australian Consumer Law.

  1. MANUFACTURERS, SUPPLIERS AND FULFILMENT PROVIDERS

We work with manufacturers, suppliers, warehouses, fulfilment providers and delivery companies in Australia and overseas.

Some products may be manufactured, packed or dispatched directly by one of these providers.

Packaging may therefore be plain, unbranded and supplied without promotional material or a printed invoice.

The involvement of a manufacturer, supplier, fulfilment provider or courier does not remove any obligation that Aussie Outdoor Cushions & Beanbags has to its customers under applicable law.

  1. RETURNS, REFUNDS AND CONSUMER GUARANTEES

Our Returns, Refunds, Warranties and Consumer Guarantees Policy forms part of these Terms.

We do not offer returns, refunds or exchanges simply because a customer changes their mind, selects an unsuitable size or colour, orders incorrectly or does not read that a product is supplied as a cover only.

Different rules apply when a product is faulty, damaged, unsafe, incorrectly supplied or materially different from its description.

Sale, discounted, bulk, custom and made-to-order products remain covered by the Australian Consumer Law where applicable.

Customers should contact us before returning a product and wait for the correct return instructions. Products must not be returned to our Stapylton, Queensland address.

  1. AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Customers may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage.

Customers may also be entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The specific remedy available depends on the product, the nature of the problem and the circumstances.

  1. PRODUCT AVAILABILITY AND DISCONTINUED PRODUCTS

Products and colourways may have limited availability or may be discontinued without notice.

We may limit quantities where reasonably necessary because of stock availability, production capacity or suspected commercial resale.

If we cannot supply a paid product, we will offer an appropriate solution, which may include:

• an alternative product with your agreement
• store credit with your agreement
• a refund to the original payment method

We will not require a customer to accept store credit when a refund is required by law.

  1. WEBSITE ACCURACY AND ERRORS

We may correct typographical errors, technical errors, inaccurate availability information or other genuine mistakes on the website.

Corrections will not remove rights already available to a customer under applicable law.

We may update website content without prior notice. However, the terms and product information applying to a purchase are generally those presented when the order was placed, subject to corrections agreed with the customer or required by law.

  1. WEBSITE AVAILABILITY

We do not guarantee that the website will always be uninterrupted, secure or error-free.

We may temporarily suspend or modify website features for maintenance, security, technical or operational reasons.

To the maximum extent permitted by law, we are not responsible for loss caused solely by temporary website interruption where we took reasonable care and the loss was not reasonably foreseeable.

This limitation does not apply to liability that cannot legally be excluded.

  1. OPTIONAL TOOLS AND THIRD-PARTY LINKS

The website may provide access to tools, payment options, applications or websites operated by third parties.

Third-party services are governed by their own terms and privacy practices. You should review those terms before using them.

We are not responsible for independent third-party content or services that we do not own, operate or control.

However, this section does not remove our responsibility for products sold directly to you by Aussie Outdoor Cushions & Beanbags.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its content are owned by or licensed to Aussie Outdoor Cushions & Beanbags.

This includes our business name, branding, written content, product descriptions, graphics, photographs, videos and website layout.

You may view and use the website for personal shopping and informational purposes.

You must not reproduce, distribute, sell, commercially exploit or create derivative works from our content without prior written permission, except where permitted by law.

  1. REVIEWS, COMMENTS AND SUBMISSIONS

You are responsible for content you voluntarily submit through our website, social-media pages or other public channels.

Submitted content must not:

• be knowingly false or misleading
• infringe another person’s intellectual property or privacy rights
• contain unlawful, defamatory, abusive or threatening material
• contain spam, malware or unauthorised advertising
• impersonate another person

We may moderate or remove content where we reasonably believe it breaches these requirements or an applicable platform policy.

Nothing in these Terms prevents a customer from making a genuine complaint, giving an honest opinion, leaving a lawful review, contacting a regulator or exercising a legal right.

If you submit a review, photograph or other content specifically for publication, you give us a non-exclusive permission to reproduce and display that content in connection with our business and products.

We will not treat private customer-service correspondence as a public testimonial without permission.

  1. PERSONAL INFORMATION

Our collection, use, storage and disclosure of personal information are governed by our Privacy Policy and applicable privacy law.

Payment information is handled through Shopify and the relevant payment providers. We do not receive or store complete credit-card details through the ordinary checkout process.

NZ privacy law applies when selling to NZ customers, and overseas disclosure needs to be handled properly.

  1. FRAUDULENT OR ABUSIVE CONDUCT

We may cancel or restrict orders where we reasonably suspect:

• fraudulent or unauthorised payment
• identity theft
• deliberate misuse of discounts
• repeated abusive purchasing activity
• commercial resale contrary to stated purchase restrictions
• threats to the safety of our staff, contractors or customers

Any payment or refund will be handled according to the circumstances, applicable payment-provider requirements and Australian law.

This section does not allow us to withhold money for products we have not supplied unless we have a lawful basis for doing so.

  1. PAYMENT DISPUTES AND CHARGEBACKS

We ask that customers allow us a reasonable opportunity to investigate and resolve the matter before initiating a payment dispute or chargeback.

For concerns about non-delivery, customers should allow the full delivery timeframe stated in our Shipping and Delivery Policy to pass before beginning a payment dispute, unless the delivery provider has confirmed that the parcel has been lost.

Receiving separate parcels on different days, not receiving a dispatch email or experiencing a delivery that remains within the published timeframe does not, by itself, mean that an order has not been supplied.

For concerns about a faulty, damaged or incorrect product, customers should follow the process in our Returns, Refunds, Warranties and Consumer Guarantees Policy and provide the information reasonably required to assess the concern.

If a chargeback or payment dispute is initiated:

• the disputed amount and an additional chargeback fee may be immediately withdrawn from us
• the dispute will be managed through the customer’s bank, card provider and our payment provider
• we may be unable to issue a separate refund while the payment dispute remains active
• we may provide the bank or payment provider with relevant order and transaction records

Evidence supplied in response to a payment dispute may include:

• the order confirmation and payment record
• the policies accepted when the order was placed
• billing and delivery information supplied by the customer
• correspondence between the customer and Aussie Outdoor Cushions & Beanbags
• order-processing and fulfilment records
• courier tracking, delivery scans and safe-place confirmation
• photographs or other evidence relating to the order or delivery

If an order is delivered after a payment dispute has been initiated, the customer must promptly notify both us and their bank or payment provider.

A customer must not retain both the delivered products and the benefit of a reversed or refunded payment for those products. Where this occurs, the customer must cooperate in withdrawing the payment dispute, restoring payment or arranging an authorised return of the products.

If a customer agrees that a chargeback was made in error or that the matter has been resolved, they must contact their bank or card provider to request withdrawal of the dispute and provide us with written confirmation where available.

We reserve the right to contest a chargeback where our records show that:

• the transaction was authorised
• the order was correctly supplied
• delivery occurred at the address provided
• the order remained within the published delivery timeframe
• the customer received the product
• the customer did not follow the stated contact, delivery or returns process
• the information provided in support of the dispute is incomplete or inconsistent with our records

Nothing in this section prevents a customer from exercising a legitimate right to dispute an unauthorised transaction, seek a chargeback or exercise rights under the Australian Consumer Law.

This section is intended to encourage customers to contact us first so that genuine order concerns can be investigated and resolved promptly.

22. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits:

• rights under the Australian Consumer Law
• liability for fraud or deliberate misconduct
• liability for personal injury or loss where it cannot legally be excluded
• any other right or liability that cannot legally be excluded or limited

To the extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach of these Terms, negligence or failure to meet an applicable legal obligation.

Customers remain responsible for loss or damage they cause through misuse, neglect, unauthorised alteration or failure to follow clear product and safety instructions.

23. TERMINATION

These Terms remain effective while you access the website or maintain an active transaction with us.

You may stop using the website at any time.

We may suspend or terminate website access where reasonably necessary to address unlawful conduct, security threats, fraud or a serious breach of these Terms.

Termination does not affect rights, payments, claims or obligations that arose before termination.

24. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our business, website, products, technology or legal obligations.

The latest version will be published on this page with an updated revision date.

Changes generally apply from the date they are published and do not retrospectively remove rights associated with an existing purchase.

25. SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

26. WAIVER

If we do not immediately enforce a provision of these Terms, this does not mean that we have permanently waived our right to enforce it.

27. ENTIRE AGREEMENT

These Terms, the policies incorporated into them and the applicable product description form the agreement between you and Aussie Outdoor Cushions & Beanbags regarding your use of the website and purchase.

Nothing in this section excludes information or representations that legally form part of the transaction.

28. GOVERNING LAW

These Terms are governed by the laws of Queensland and the Commonwealth of Australia.

Nothing in this section restricts any right a customer may have to bring a claim in another jurisdiction where that right cannot legally be excluded.
